Indeed, the FDA has warned the public against the use of kratom for medical treatment, as a dietary supplement, or as a food additive because of the risk of serious adverse events which may include liver toxicity, seizures, heart failure, respiratory failure, liver failure, lung hemorrhaging and, in some cases, death.

Other criteria may apply in order to be eligible. Not all individuals or cases qualify for a Kratom injury or death lawsuit.   • May 2026: – Current Status of Kratom Lawsuits: Kratom injury and wrongful death lawsuits are being investigated and filed in state and federal courts. There is currently no publicly established nationwide kratom MDL or global injury settlement program. Recent lawsuits continue to focus on allegations that kratom manufacturers, distributors, and retailers failed to warn consumers about risks of overdose, seizures, organ damage, respiratory depression, and death.
  • March 2026 – Louisiana Kratom Wrongful Death Case Continues: On March 30, 2026, a federal court in Louisiana issued an order granting in part and denying in part Defendants motion to dismiss a kratom wrongful death/product liability case involving allegations that an OPMS kratom product was unreasonably dangerous because of inadequate warnings and a defective design. The lawsuit alleged that Harmony Moller died after consuming OPMS kratom. The case highlights how plaintiffs are increasingly targeting not only retailers, but also alleged distributors, manufacturers, and related business entities in the kratom supply chain.
  • March 2026 – Missouri Wrongful Death Lawsuit Filed: On March 6, 2026, a Kansas City-area family filed a wrongful death lawsuit in Jackson County Circuit Court after David Thacker allegedly died from mitragynine, the primary alkaloid in kratom. The lawsuit alleges that kratom manufacturers and sellers sold products without adequate warnings and that one retailer sold “house blend” kratom in unmarked bags with no warning labels.
  • 2025 – FDA Targets Concentrated 7-OH Products: In July 2025, the FDA issued warning letters to companies marketing products containing 7-hydroxymitragynine, also known as 7-OH, including tablets, gummies, drink mixes, and shots. Later that month, the FDA announced that it was recommending scheduling action for certain 7-OH products under the Controlled Substances Act, while clarifying that the action targeted concentrated 7-OH products rather than natural kratom leaf products. These developments may be relevant to future kratom product liability claims involving potency, labeling, warnings, overdose, or death.
  • September 2024 – Colorado Wrongful Death Lawsuit Filed: The widow of Robert Simmons filed a wrongful death lawsuit in Colorado state court alleging that kratom companies and sellers failed to disclose the risks of kratom, failed to provide adequate warning labels, and marketed kratom products for purported medicinal benefits despite no FDA approval for those uses.
  • February 2024 – Oregon Kratom Wrongful Death Lawsuit Filed: On February 27, 2024 a Kratom wrongful death lawsuit complaint was filed by the estate of an individual who allegedly suffered seizures and convulsions and died after consuming Kratom due to alleged “toxic effects of mitragynine,” (i.e., kratom overdose). The Kratom lawsuit, styled as the Estate of Matthew J. Torres by Mary C. Torres v. House of Pipes et al., Case No. 24-CV-10003, Multnomah County Circuit Court in the State of Oregon, asserts claims for negligence, strict liability, breach of implied warranty of merchantability, negligent misrepresentation and negligence per se. The Kratom wrongful death lawsuit seeks, among other things, damages for disability, pain, and suffering of the decedent, reimbursement for medical expenses, compensation to decedent’s beneficiaries for pecuniary loss to the decedent’s estate and/or beneficiaries and for loss of the society, companionship and services of the decedent.
  • December 2023 – Washington Kratom Wrongful Death Lawsuit Filed: On December 8, 2023, a Kratom lawsuit complaint was filed by the estate of a 37-year-old man who passed away after ingesting Kratom products. The Kratom wrongful death suit, captioned as the Estate of Jordan McKibban by Jordan McKibban v. Jopen et al., Case No. 23-2-01183-08, Superior Court of State of Washington, alleges claims for failure to warn, design and manufacturing defect, breach of warranty, misrepresentation, negligence and unfair trade practices and seeks general and special damages, among other things.
  • July 2023 – Florida Court Awards $11 Million in Kratom Wrongful Death Case: On July 26, 2023 a Judge, in a Kratom wrongful death lawsuit styled as Devin Filippeli as personal representative of the Estate of Krystal Talavera v. Grow, LLC (d/b/a KD Incorporated and The Kratom Distro) et. al., Case No. 22-81731-CV-Middlebrooks, United States District Court for the Southern District of Florida, awarded $11 million dollars to the family of a 39 year old woman who died after taking Kratom.
  • July 2023 – Washington Jury Awards $2.5 Million in Kratom Death Case: On July 18, 2023 a jury, in a Kratom wrongful death lawsuit styled as Sybil Coyne individually and as Personal Representative of the Estate of Patrick Coyne, deceased, vs. Society Botanicals, LLC (d/b/a Kratom Divine) et. al., Case No. 20-2-00874-08, Superior Court of the State of Washington, Cowlitz County, awarded $2.5 million to the family of a 39-year-old man who died after consuming Kratom powder.

The adverse effects of Kratom can range from mild side effects (e.g., nausea, constipation, dizziness and drowsiness) to severe side effects (e.g., tremors, seizures, heart problems, lung problems, liver problems and death). According to Mayo Clinic, poison control centers in the United States received about 1,800 reports involving use of kratom from 2011 to 2017, including reports of death and seizures, among others.
