According to the Rape, Abuse & Incest National Network (RAINN), the term “sexual assault” refers to sexual contact or behavior that occurs without explicit consent of the victim. Uber’s US Safety Report defines “sexual assault” as any physical or attempted physical contact that is reported to be sexual in nature and without the consent of the user, which can include incidents ranging from attempted touching of a non-sexual body part (e.g., a user trying to touch a person’s shoulder in a sexual/romantic way) to non-consensual sexual penetration. Touching can include, for example, a kiss, lick, or bite.

Uber’s US Safety Report defines sexual misconduct as non-physical conduct (verbal or staring) of a sexual nature that happens without consent or has the effect of threatening or intimidating a user against
whom such conduct is directed, which can include incidents such as staring/leering (gazing at a user in an unpleasant, uncomfortable, prolonged, or sexual manner), asking personal questions (asking specific, probing, and personal questions of the user including romantic or sexual preferences), making comments about a user’s appearance, flirting (making verbally suggestive comments to the user about engaging in romantic or non-romantic activities), making explicit gestures, making explicit comments (describing or representing sexual activity or body parts in a graphic fashion), displaying indecent material such as pornography or other sexual images, making indecent photography/video without consent (inappropriate photographs of a user’s sexual body part such as down shirt, up skirt, etc.), soliciting a sexual act (asking for a kiss, display of nudity, sex, or contact with a sexual body part such as a breasts, buttock, genitals, etc.), masturbating or exposing genitalia, and verbal threat of sexual assault.

Sexual Assault Lawsuits Against Uber

The sexual assault lawsuits filed against Uber in federal district court were consolidated and/or transferred into a multi district litigation or MDL for coordinated pretrial proceedings, styled as In Re: Uber Technologies, Inc. Passenger Sexual Assault Litigation, MDL Case No. 3084, United States District Court for the Northern District of California (Judge Charles R. Breyer). Defendants in the Uber lawsuits have included Uber Technologies, Inc. and Rasier, LLC, a subsidiary of Uber.
