The NuVasive MAGEC system (or MAGnetic Expansion Control system) is a titanium spinal rod system or spinal implant device intended for use in children with early onset scoliosis or EOS (i.e., children under 10 years of age who have a curvature of the spine) that uses magnets to help correct spinal deformities as the child grows (by lengthening the rods every 3 to 6 months) and is designed to help children avoid spinal fusions and multiple surgical operations to correct the spinal curve.

In July 15, 2021 the FDA issued a Safety Communication informing patients, caregivers, and health care providers of potential mechanical failures and concerns about tissue incompatibility (biocompatibility) associated with components of certain NuVasive Specialized Orthopedics’ MAGEC devices.

According to the FDA, there have been reports of endcap separation, O-ring seal failure, and potential exposure of internal components of the device to living tissue that may lead to adverse local tissue reactions.

NuVasive MAGEC Lawsuit Cases

NuVasive MAGEC lawsuit and settlement cases potentially being investigated include claims involving children who suffered serious injuries or complications relating to a NuVasive MAGEC spinal implant and its associated components, including the following:

  • NuVasive MAGEC 2 Spinal Bracing and Distraction System
  • NuVasive MAGEC System

NuVasive MAGEC Recall

In February 2020, NuVasive also issued an Urgent Field Safety Notice recalling certain MAGEC devices (MAGEC System Model X rods) to address a mechanical component failure where the endcap was separating from the rod part of the device (which may expose internal components of the actuator, which could lead to hastened degeneration of the internal components and egress of Titanium alloy wear debris and resultant localized tissue discoloration).

NuVasive MAGEC Injuries & Complications

NuVasive MAGEC injury cases and settlement claims potentially being investigated include claims involving children who had a NuVasive MAGEC system surgically implanted in their spine and subsequently suffered serious injuries or complications, including, among others:

  • Metallosis
  • Metal poisoning in blood

Long terms complications of metallosis can include vision problems, hearing problems, cognitive impairment, nerve damage, infection, heart failure, thyroid problems, gastrointestinal issues and skin rashes.

According to a study, metals (including titanium, vanadium and possibly aluminum) may be released from magnetically controlled spinal growing rods. According to another study, high volumes of titanium wear debris alongside O-ring seal damage may account for metallosis reported clinically around some MAGEC rods. In another study, numerous patients were reported to have suffered complications, including broken rods, drive pins or failure of a rod to lengthen, requiring revision surgery.
