3M earplug lawsuit and settlement cases potentially being investigated include claims of current and former service members of the armed forces (soldiers, sailors, marines, veterans and other current and former military personnel, etc.) who allege to have suffered hearing loss and auditory injuries after using 3M Combat Arms earplugs.

In July 2018, 3M settled a false claims act lawsuit brought by the United States government for $9.1 million that involved allegations that 3M supplied the United States military with defective dual-ended Combat Arms Earplugs, Version 2 (CAEv2) that were too short to be adequately inserted into service members’ ears and that the 3M earplugs might loosen rendering the 3M earplugs less effective or even useless, thereby allowing loud noise to pass through the protective earplugs.

Hearing Loss Cases

3M earplug lawsuit and settlement cases potentially being investigated include hearing loss injuries, symptoms, side effects and complications, including, among others, the following:

  • Total hearing loss
  • Partial hearing loss
  • Tinnitus
  • Acute acoustic trauma
  • Deafness
  • Other hearing related injuries

Hearing loss signs and symptoms can include difficulty understanding words, problems hearing consonants, muffled speech, asking other people to talk slower, clearer and/or louder, withdrawing from conversations, inability to hear sound frequencies, needing hearing aids, among others.

Hearing loss lawsuit claims might include service members who were exposed to loud impulse noises like weapon fire, improvised explosive devices IEDs, artillery, gun fire and explosions, as well as high, constant, steady loud sounds such as noise from aircraft, helicopters, armored vehicles, watercraft, engines and heavy machinery.

Tinnitus Lawsuit Claims

Hearing loss is commonly associated with tinnitus. Tinnitus has been described as the perception or sense of hearing sounds when no external sounds are present. For example, those suffering from tinnitus might hear:

  • ringing
  • buzzing
  • roaring
  • clicking
  • hissing
  • drilling
  • shilling
  • pulsating
  • humming
  • white noise
  • other phantom noises or sounds

Unfortunately, hearing loss can be irreversible and can negatively effect the quality of a service member’s life, including difficulty concentrating, stress, memory problems, sleep issues, depression, anxiety, irritability, cognitive impairment, and feelings of isolation, among other things.

3M military earplug lawsuits filed in federal district courts have been consolidated and/or transferred into a multi-district litigation or 3M combat arms earlpug MDL, styled 3M Combat Arms Earplug Products Liability Litigation (FLN), Case No. MDL 2885 in the United States District Court for the Northern District of Florida.

Defendants in the 3M military earplugs MDL proceedings have included 3M Company, Aearo Technologies LLC, Aearo Holdings, LLC, Aearo Intermediate, LLC, and Aearo, LLC.
