If you or a loved one were diagnosed with pneumonia or chemical pneumonitis after using a recalled Philips CPAP, BiPAP or ventilator machine, you may be entitled to recover compensation from a CPAP pneumonia lawsuit case or settlement claim.
A team of medical device injury lawyers and class action attorneys is investigating potential lawsuit cases and settlement claims of individuals who were diagnosed with pneumonia or chemical pneumonitis after using a recalled Philips CPAP, BiPAP or ventilator machine.
Pneumonia is an infection of the lung(s) that leads to swelling or inflammation of the lungs’ air sacs or alveoli. Pneumonia can be caused by, among other things, bacteria, viruses, fungi, or chemical irritants (such as inhalation of toxic gases and particulates).
Each year in the United States, a million adults are hospitalized for pneumonia and about 50,000 die from pneumonia.
CPAP Pneumonia Lawsuit Cases
CPAP pneumonia lawsuit cases and settlement claims potentially being investigated include claims of patients who, after using a recalled Philips C-PAP, Bi-PAP or ventilator device (such as a DreamStation, C-Series, Dorma, OmniLab AdvancedPlus, REMstar, System One, A-Series, Garbin Plus, Aeris, LifeVent or Trilogy ventilator), were diagnosed with pneumonia or chemical pneumonitis, including:
- Pneumonia
- Chemical pneumonia
- Aspiration pneumonia
- Chemical pneumonitis
- Lobar pneumonia
- Bronchial pneumonia
- Bronchopneumonia
Chemical pneumonia (or aspiration pneumonia or chemical pneumonitis) is a type of pneumonia that is caused by the aspiration or inhalation of chemical irritants, poisons, toxins or other harmful particulates.
On June 14, 2021, it was reported that Philips was recalling certain CPAP, BiPAP, and ventilator machines due to possible health risks, including potential respiratory issues, relating to the potential exposure to particulates from degraded polyester-based polyurethane sound abatement foam in the recalled devices.
Pneumonia Signs & Symptoms
Signs and symptoms of pneumonia can potentially include:
- Difficulty breathing (dyspnea)
- Dry cough
- Productive cough
- Green, yellow or bloody mucus
- Chest pain
- Fever
- Shaking chills
- Excessive sweating
- Rapid, shallow breathing
- Cracking or bubbling sounds when breathing

- Wheezing
- Headaches
- Joint pain
- Muscle pain
- Rapid heartbeat
- Loss of appetite
- Fatigue
- Nausea

Procedures and tests used to diagnose pneumonia can include physical examination, chest X-ray or CT scan (to look for inflammation in the lungs), pulse oximetry (to measure oxygen levels in the blood), sputum test of mucus (to look for source of infection), arterial blood gas test (to check oxygen levels in blood from sample taken from artery), pleural fluid culture, blood tests (such as CBC), bronchoscopy (to look into the lungs), and lung ultrasound, among others.
Pneumonia Complications
Pneumonia can potentially lead to serious complications including breathing difficulties, fluid buildup in the lungs (pleural effusion), lung abscess (pus in cavities of the lungs), hypoxia (insufficient oxygen), sepsis (uncontrolled inflammation in the body that can lead to organ failure), pleurisy or pleuritis (condition in which pleura, or large thin layers of tissue that separate lungs from chest wall, become inflamed), kidney failure, pulmonary fibrosis or lung scarring, acute respiratory distress syndrome (ARDS), respiratory failure, and death, among others.
Treatments for Pneumonia
Treatment for pneumonia, which depends on the type and severity of pneumonia and other criteria, can include antibiotics, antiviral medicines, antifungal medicines, corticosteroids (to reduce inflammation), non-steroidal anti-inflammatory drugs, pain medicines, cough relief medicine, IV intravenous fluids, getting sufficient rest, oxygen therapy and other breathing treatments, among others.
