A team of medical device injury lawyers and class action attorneys is investigating potential lawsuit cases and settlement claims of individuals who were diagnosed with kidney cancer or renal cancer after using or being treated with a recalled Philips CPAP, BiPap or ventilator.

Kidney cancer (a/k/a renal cancer, renal pelvis cancer or renal cell cancer) is a type of cancer that begins in the kidney when cells in the kidney become abnormal and begin to grow out of control.

According to the American Cancer Society, more than 76,000 new cases of kidney cancer are diagnosed each year in the U.S. and more than 13,700 deaths are expected in the U.S. from kidney cancer.

CPAP Kidney Cancer Lawsuit Cases

CPAP kidney cancer lawsuit cases and settlement claims potentially being investigated include claims of patients who, after using a recalled Philips C-PAP, BiPAP or ventilator were diagnosed with:

  • Kidney cancer
  • Renal cancer
  • Renal cell carcinoma (RCC)
  • Clear cell renal cell carcinoma (ccRCC)
  • Papillary renal cell carcinoma (PRCC)
  • Chromophobe renal cell carcinoma (RCC)
  • Translocation renal cell carcinoma (TRCC)
  • Collecting duct carcinoma (Bellini duct carcinoma)
  • Cystic Renal Cell Carcinoma (CRCC)
  • Transitional cell carcinoma (TCC) of the renal pelvis
  • Urothelial carcinoma of the renal pelvis
  • Other types of cancers

In June of 2021, the FDA issued a safety communication alerting people who used certain Philips Respironics ventilators, BiPAP, and CPAP machines that Philips recalled the devices due to possible health risks, including toxic and carcinogenic effects to organs such as the kidneys, related to the polyester-based polyurethane sound abatement foam in the devices. Recalled Philips CPAP, BiPAP or ventilators include DreamStation, C-Series, Dorma CPAP, OmniLab Advanced+, REMstar CPAP, SystemOne, A-Series BiPAP, Garbin Plus, Aeris, LifeVent Ventilator, Trilogy Ventilator and E30 devices.

Types of Kidney Cancer

There are many types of kidney cancer. Renal cell carcinoma is the most common form of kidney cancer, accounting for about 80-85% of all malignant kidney tumors. With renal cell carcinoma, malignant cells develop in the lining of the kidney tubules and grow into a tumor or mass.

Sub-types of renal cell carcinoma include clear cell renal carcinoma (comprising about 75% of all renal cell carcinomas), papillary renal cell carcinoma (comprising about 10-15% of all renal cell carcinomas), chromophobe renal cell carcinoma (comprising about 5% of all renal cell carcinomas), translocation renal cell carcinoma (comprising about 1% of all renal cell carcinomas), cystic renal cell carcinoma (comprising about 2.5% of all renal cell carcinomas), renal medullary carcinoma (comprising about .5% of all renal cell carcinomas) and collecting duct carcinoma (comprising about .5% of all renal cell carcinomas). Other forms of kidney cancer include, among others, renal sarcoma, and urothelial carcinoma or transitional cell carcinoma of the renal pelvis (the part of the kidney that collects urine and drains it into a tube called the ureter).

Signs & Symptoms of Kidney Cancer

Signs and symptoms of kidney cancer can include:

  • Anemia (decrease in hemoglobin or red blood cells)
  • Blood in urine (hematuria)
  • Sudden and unintended weight loss
  • Lower back pain
  • Lump in abdomen
  • Lump in lower back or side of waist
  • Flank pain
  • Flank mass
  • Fever
  • Night sweats
  • Loss of appetite
  • Cachexia
  • Fatigue
  • Feeling of poor health
  • Varicocele (enlarged varicose vein)
  • Swelling
  • Flushing

Kidney cancer complications can include, among others, kidney failure, liver dysfunction, high blood pressure (hypertension), hypercalcemia (elevated calcium levels), paraneoplastic syndromes, increased red bloods (polycythemia), disorders of nerves, disorders of muscles (neuromyopathies), disorders of blood vessels (vasculopathy) and disorders of blood clotting mechanisms (coagulopathy), kidney cancer metastasis to other parts of the body and/or death.

Tools and procedures used to diagnose kidney cancer can include a medical history, family history, physical exam, imaging tests (x-ray, CT scan, PET scan, MRI, ultrasound, etc.), lab tests (blood tests, urine tests, urine cytology, urinalysis), renal arteriogram, angiography, bone scan and kidney biopsy, among others.

Treatments for Kidney Cancer

Treatment for kidney cancer can include surgery (removal of part or all of kidney or nearby organs such as a partial nephrectomy, radical nephrectomy or simple nephrectomy), thermal ablation or radiofrequency ablation, cryotherapy, active surveillance, arterial embolization, chemotherapy, raditiation therapy, immunotherapy, targeted drug therapy, dialysis machine, and/or a kidney transplant, among others.
